REQUIREMENTS:
- Postgraduate qualification in Finance or Legal fields (NQF 8) or equivalent
- Strong expertise and experience in financial misconduct, with legal knowledge in Labour Law or Public Administration/Governance/Ethics and Fraud Investigations
- Good understanding of internal controls and Corporate Governance in Local Government
- Experience serving on a Disciplinary Board for Financial Misconduct in a local government setting
- Knowledge of the Municipal Finance Management Act No. 56 of 2003 and its regulations
- Knowledge of the Local Government: Municipal Systems Act, No. 32 of 2000 and its regulations
- Membership in good standing with a recognized professional body
- In terms of Regulation 4(5), the following persons are disqualified as members:
- A person convicted of an offence under these regulations or any other legislation
- A person convicted of theft, fraud, forgery, uttering a forged document, or any offence involving dishonesty, whether in South Africa or elsewhere
- A person removed from any office of trust due to misconduct or dishonesty
- An Accounting Officer of a Municipality or Municipal Entity
- A political office-bearer or member of a board of directors
- An office-bearer in a political party
- A person serving on more than three (3) Financial Misconduct Boards
- A person employed by the King Cetshwayo District Municipality
KEY FUNCTIONS:
- Investigate and advise the Municipal Council, political office-bearers, the Accounting Officer, management, and staff on matters of financial misconduct. Provide recommendations on disciplinary proceedings or other appropriate actions.
- Monitor the start of disciplinary proceedings against those involved.
- Submit investigation outcome reports to the Mayor or Accounting Officer as needed.
- Liaise with the Speaker on reports submitted to the Mayor or Accounting Officer.
- Submit final investigation reports to the KZN Provincial Treasury.
- Engage with the KZN Provincial Treasury and/or National Treasury when a Council fails to act on recommendations without providing reasons to the board.
