Director: Tax Legislative Drafting

Purpose of the Role
To draft and review all tax and other revenue legislation, support its legislative processes including stakeholder engagement, comment on draft legislation that affects tax and revenue laws, and advise on the interpretation of tax and other revenue legislation.
Qualification Requirements
- A Grade 12 certificate, plus a minimum Bachelor’s degree (NQF level 7) in Law or an LLB.
- A postgraduate or LLM qualification in Tax Law is an advantage.
- At least 5 years’ experience at a middle or senior managerial level in legislative drafting.
- Knowledge and experience in constitutional law, drafting legal documents, and/or legislation.
- Experience with the Executive and Parliament’s processes for considering draft legislation.
- Completion of the Nyukela Public Service Senior Management Leadership Programme, as endorsed by the National School of Government (available online at their website), before final appointment.
Key Performance Areas
Drafting and Scrutiny of Tax and Other Revenue Legislation
- Develop key design measures for drafting new or amended tax and revenue legislation, and prepare the drafts.
- Review draft revenue legislation from other institutions, such as SARS.
- After stakeholder consultations, draft necessary amendments to revenue legislation.
- Oversee editing and document control for clear and accurate revenue legislation.
- Facilitate translation of draft tax and revenue Bills into other official languages.
Revenue Legislative Process Engagement
- Participate in stakeholder consultation meetings.
- Coordinate drafting inputs from key stakeholders, such as SARS and tax practitioners.
- Facilitate review of draft revenue legislation by the Office of the Chief State Law Adviser (Department of Justice and Constitutional Development) and liaise with Parliamentary Legal Advisers.
- Manage the engagement schedule for drafting coordination within the National Treasury, Executive, and Parliament.
- Support the Parliamentary process for tax and revenue Bills.
- Facilitate translation of draft Bills into other official languages.
Drafting and Scrutiny of Legal Instruments under Tax and Revenue Legislation, and Comments on Related Draft Legislation
- Draft regulations, notices, and other legal instruments for the National Treasury or the Minister of Finance.
- Review regulations, notices, and legal instruments prepared by other institutions, such as SARS, for issuance by the National Treasury or Minister.
- Align editing and document control for these legal instruments.
- Provide inputs on draft legislation from other national departments that impacts tax and revenue laws.
Interpretation of Tax and Other Revenue Legislation
- Advise internal and external stakeholders on the interpretation of tax and revenue legislation.
- Liaise with other units in the National Treasury or relevant institutions for consultations.
- Facilitate legal opinions on interpretations from the Office of the Chief State Law Advisers or private legal practitioners.
