Purpose of the Role

  • Oversee the drafting and review of all tax and other revenue legislation, including the legislative processes. This involves engaging stakeholders, commenting on draft legislation that affects revenue laws, and advising on the interpretation of revenue legislation.

Qualification Requirements

  • A Grade 12 certificate is required, along with at least a Bachelor’s degree in Law or LLB (equivalent to NQF level 7).
  • A relevant qualification at NQF level 8.
  • A postgraduate qualification or LLM in Tax law, and completion of a legislative drafting course, will be an advantage.
  • At least 5 years of experience at a senior managerial level in legislative drafting, other documents, and the broader legal field. Knowledge and experience in constitutional law and the interpretation of statutes.
  • Experience in the Executive and Parliament’s processes for reviewing draft legislation.
  • Successful completion of the Nyukela Public Service Senior Management Leadership Programme, as endorsed by the National School of Government. This is available as an online course on the NSG website, and must be completed before the appointment is finalized.

Key Performance Areas

Oversee Drafting and Review of Tax and Other Revenue Legislation:

  • Lead and develop key design measures for drafting new and amended tax and revenue legislation, and oversee or draft the legislation.
  • Manage the review of draft revenue legislation from other institutions, such as SARS.
  • After stakeholder consultations, oversee the drafting of, or draft, the resulting amendments to revenue legislation.
  • Manage the editing and document control of legislative documents to ensure clear and sound revenue laws.
  • Facilitate the translation of draft tax and revenue Bills into another official language.

Manage Engagement in the Revenue Legislative Process:

  • Lead stakeholder consultations on legal aspects.
  • Coordinate drafting inputs from key stakeholders, such as SARS and tax practitioners.
  • Facilitate the review of draft revenue legislation by the Office of the Chief State Law Adviser (Department of Justice and Constitutional Development) and liaise with Parliamentary Legal Advisers.
  • Oversee the schedule for drafting coordination within the National Treasury, the Executive, and Parliament.
  • Lead the Parliamentary process for tax and revenue Bills on legal aspects.

Oversee Drafting and Review of Legal Instruments Under Tax and Revenue Legislation, and Comment on Draft Legislation Affecting Revenue Laws:

  • Oversee the drafting of, or draft, regulations, notices, and other legal instruments issued by the National Treasury or the Minister of Finance.
  • Review regulations, notices, and other legal instruments prepared by other institutions, such as SARS, for issuance by the National Treasury or the Minister of Finance.
  • Ensure proper editing and document control for these legal instruments.
  • Provide inputs and coordinate on draft legislation from other national departments that may affect tax and revenue laws.

Supervise Interpretation of Tax and Other Revenue Legislation:

  • Oversee and provide advice on the interpretation of tax and revenue legislation to internal and external stakeholders.
  • Liaise with other units in the National Treasury or external institutions on interpretations.
  • Facilitate opinions on interpretations from the Office of the Chief State Law Advisers or private legal practitioners.
