Job Purpose

To make non-compliance hard and costly by ensuring consequences for non-payment of debt.

Education and Experience

Minimum Qualification and Experience Required

  • A relevant National Diploma or Advanced Certificate (NQF 6) in Credit Management, Legal, or Finance, plus 2-3 years of debt collection experience, or 2-3 years in a commerce environment, with at least 1-2 years at a knowledge worker level.
  • Articles would be an advantage.

Minimum Functional Requirements

  • Knowledge of legal aspects of collections (such as sequestrations and liquidations) and/or in-depth analysis of financial statements (including ratio analysis and interpretation).

  • Apply relevant legislation, policies, procedures, and standard operating procedures (SOPs).
  • Conduct pre-assessment profiles of taxpayers, including related parties, and identify risks to SARS.
  • Assess debt collectability, evaluate asset dissipation risks, check for disputes, and recommend preservation orders or caveats.
  • Complete referrals for suspicious activities and follow up with stakeholders.
  • Prepare collection input reports for cases presented to Large Assessments or National Appeals Committees.
  • Execute legal enforcement actions under the Tax Administration Act (TAA) and Companies Act for all tax types.
  • Profile, analyze, prepare, and present submissions for suspension of payment or write-off to the Debt Committee, and record outcomes.
  • Analyze, negotiate, prepare, and present deferral or compromise settlement requests to the Debt Committee, and notify taxpayers of outcomes.
  • Monitor payments under deferral or compromise agreements, update records, and close files upon full payment.
  • Conduct physical verification and evaluation of movable and immovable assets.
  • Review and process motivations for or against business rescue plans and present to committees, or refer for specialization.
  • Monitor compliance with legislation during business rescue and ensure payments are received.
  • Gather documentation for liquidation or sequestration applications, upload for case coding, and refer as needed.
  • Attend internal and external meetings, including creditors’ meetings, court proceedings, and tax enquiries.
  • Reduce the debt book through approved adjustments and write-offs.
  • Analyze liquidation plans, sequestrations, business rescues, trusts, or other liable creditors and recommend further actions.
  • Initiate and execute enforcement actions to maximize returns for SARS.
  • Prepare motivations for or against enforcement actions, highlight risks, and present to committees for approval.
  • Participate in debt collection from high-risk projects identified by Audit and Investigations.
  • Identify taxpayer assets in foreign countries and refer for international recovery.
