Requirements

  • A degree in Law (LLB) at NQF level 7 or an equivalent qualification recognized by SAQA.
  • Five (5) years of experience at middle or senior management level in a similar environment.
  • A certificate for entry into the Senior Management Service (SMS) from the National School of Government (NSG) is required.
  • Admission as an advocate or attorney is an advantage.
  • Computer literacy.
  • A valid driver’s license.

Required Knowledge

  • Knowledge of public service policies and legislation, including the Public Service Act and Regulations, Public Finance Management Act (PFMA), and Correctional Services Act 111 of 1998 (as amended).

  • In-depth knowledge of human resources legislation and frameworks.

Responsibilities

  • Manage the drafting, editing, and checking of legal contracts for commercial and international agreements, memoranda of understanding, memoranda of agreement, service level agreements, and implementation protocols.
  • Facilitate concession agreements.
  • Provide legal advice on processes and procedures for commercial and international agreements.
  • Ensure the department’s interests are protected in all agreements and memoranda.
  • Advise on compliance matters for contract management.
  • Set up reporting requirements for participants.
  • Advise the department on its contractual rights and obligations.
  • Manage litigation related to contracts.
  • Strengthen the department’s legal capacity during negotiations, agreements, contracts, and litigation.
  • Oversee detailed legal analysis of contracts.
  • Provide legal advice and support on interpretations, liabilities, exercising power, and other legal issues.
  • Ensure compliance with international organizations’ requirements.
  • Monitor implementation and advise on the interpretation and application of legislation.
  • Execute judicial acts, such as writing off debts, recovering losses, and handling settlements.
  • Draft documents for state attorneys and law advisors to provide formal legal opinions.
  • Conduct ongoing legal research for drafting opinions.
  • Assist in developing policies by providing legal support, vetting, editing, and certifying compliance with the constitution and national laws.
  • Liaise, negotiate, and instruct offices of the State Attorney, Chief State Law Advisor, Solicitor-General, and private lawyers and advocates.
  • Represent the department in various legal forums.
  • Build working relationships with diverse stakeholders.
  • Manage performance information, human resources, finances, and assets.
